Terms & Conditions

1. Definitions

In these Terms & Conditions, the following definitions apply:

  • "Bestari Lindung" / "we" / "us" / "our" — the legal practice operating at 7, Jalan Tunku Abdul Rahman, 93100 Kuching, Sarawak, Malaysia.
  • "Client" / "you" — any individual who engages or enquires about our services.
  • "Services" — the pension legal services offered by Bestari Lindung, as described on our website and in individual engagement agreements.
  • "Engagement Agreement" — the written agreement entered into between Bestari Lindung and a Client prior to the commencement of any legal service.
  • "Website" — the website operated by Bestari Lindung at bestaril.club.
  • "Fee" — the stated price for a Service, denominated in Malaysian Ringgit (MYR).

2. Acceptance of Terms

By using our website or engaging our services, you confirm that you have read and agree to these Terms & Conditions. These terms apply in addition to any Engagement Agreement entered into for a specific service.

Our services are available to individuals aged 18 or above who have the legal capacity to enter into binding agreements under Malaysian law. By contacting us or engaging our services, you confirm that you meet these requirements.

3. Description of Services

Bestari Lindung provides the following pension legal services to clients in Malaysia:

  • Retirement Readiness Legal Review (MYR 700)
  • Pension Suspension Appeals (MYR 1,080)
  • Multi-Scheme Pension Coordination (MYR 1,460)

Each service is described in detail on our website and in individual Engagement Agreements. Services are provided to clients located in Malaysia. Enquiries from outside Malaysia may be accommodated at our discretion where the relevant pension schemes are governed by Malaysian law.

4. Client Responsibilities

To enable us to deliver our services effectively, you agree to:

  • Provide accurate, complete, and truthful information relevant to your matter
  • Promptly respond to requests for documentation or clarification
  • Notify us of any material change in your circumstances that may affect the conduct of your matter
  • Use our website and communications in good faith and in accordance with applicable Malaysian law
  • Not attempt to use our services to facilitate any unlawful purpose

5. Intellectual Property

All content on our website, including text, design, and layout, is the property of Bestari Lindung and may not be reproduced without our written permission.

Documents prepared for you in the course of a service engagement — including readiness files, submissions, and coordination summaries — are provided for your personal use in connection with your pension matter. They may not be resold or distributed as legal advice to third parties. Bestari Lindung retains the underlying methodologies and templates used in their production.

6. Payment Terms

All fees are stated in Malaysian Ringgit (MYR) and are inclusive of applicable taxes. The fee for each service is confirmed in the Engagement Agreement prior to commencement of work.

Payment terms, including timing and method, are specified in the individual Engagement Agreement. Work will not commence until the Engagement Agreement is signed and any required initial payment is received.

Fees are fixed for the agreed scope. If additional scope is requested or becomes necessary, this will be discussed and agreed in writing before any additional work proceeds. No additional charges will arise without your prior agreement.

Refunds: If an engagement is terminated before completion, fees attributable to work already undertaken are not refundable. Fees for work not yet commenced will be returned. This will be assessed on the basis of the Engagement Agreement and the progress of the matter at the time of termination.

7. Service Delivery

Services are delivered as described in the Engagement Agreement. Indicative timelines are provided for guidance; actual timelines may vary depending on the complexity of the matter, client responsiveness, and the involvement of third parties such as pension scheme administrators or government offices.

Where a delay is caused by a third party outside our control, we will inform you promptly and advise on the expected impact. We will take reasonable steps to minimise delays within our control.

Each engagement concludes with the delivery of the agreed written output — a readiness file, submission documents, or coordination summary — as specified in the Engagement Agreement.

8. Confidentiality

All information provided by you in the course of an engagement is treated as confidential and subject to solicitor-client privilege. We will not disclose your information to third parties without your knowledge, except where required by law or with your express consent for the purpose of conducting your matter. Our obligations of confidentiality survive the conclusion of any engagement.

9. Disclaimers

Legal advice is provided on the basis of the information available and the law as it stands at the time of the engagement. We cannot account for subsequent changes in legislation, scheme rules, or administrative practice that may affect your position after the conclusion of an engagement.

General information on our website is provided for informational purposes and does not constitute legal advice. You should not act on website content alone without seeking specific advice in relation to your circumstances.

10. Limitation of Liability

To the extent permitted by Malaysian law, Bestari Lindung's liability to you in connection with a service engagement shall not exceed the total fees paid by you for that specific engagement.

We are not liable for outcomes dependent on the decisions of third parties — including pension scheme administrators, government offices, or courts — or for circumstances beyond our reasonable control, including administrative delays, legislative changes, or force majeure events.

11. Termination

Either party may terminate an engagement by providing written notice. Upon termination, fees for work completed to that point apply; fees for uncommenced work will be returned as described in Section 6.

Bestari Lindung reserves the right to terminate an engagement if a Client provides materially false information, fails to cooperate within a reasonable timeframe, or requests that we act contrary to our professional obligations under the Legal Profession Act 1976.

Provisions relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive termination.

12. Dispute Resolution

These Terms & Conditions are governed by the laws of Malaysia. Any dispute arising in connection with these terms or our services shall first be addressed through good faith discussion between the parties.

If no resolution is reached within 30 days, disputes may be referred to mediation under the Malaysian Mediation Centre. If mediation does not resolve the matter, disputes shall be subject to the exclusive jurisdiction of the courts of Sarawak, Malaysia.

13. General Provisions

  • Entire agreement: These Terms and the applicable Engagement Agreement constitute the entire agreement between the parties for the relevant service.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights or obligations under these terms without our written consent. We may assign our obligations to a qualified successor with reasonable notice.
  • Notices: Formal notices should be directed to [email protected] or to our registered office address.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. Updated versions will be published on this page with a revised effective date. Ongoing engagements are governed by the terms in effect at the time the Engagement Agreement was signed, unless both parties agree otherwise in writing.
